1. GENERAL

These terms and conditions apply to the sale of tests, training, and similar services through the following websites operated by Osaamistehdas Oy (hereinafter referred to as the "Service Provider"): Osaamistehdas.fi and Hygienepassport.fi. These terms may also apply to sales outside of the online store if the Service Provider refers to their applicability in an offer or written agreement.

Customers of the Service Provider may include consumers, companies, organizations, and sole proprietors.

The Service Provider reserves the right to amend these terms. Amended terms will be published on these websites. Orders and agreements are governed by the terms in effect at the time of the order or agreement. The Service Provider also reserves the right to update or change the prices, contents, and disclosed delivery or other fees of its services. The essential characteristics of the services are presented in the service descriptions on the relevant webpages.

3. DESCRIPTION OF SERVICES

Osaamistehdas.fi:
  • The service includes the rental of meeting, working, and event spaces for groups of various sizes at Osaamistehdas' or its partners' premises in Helsinki. Reservations are made by email.
  • The price includes use of the selected space for the reserved time and basic equipment (e.g., Wi-Fi, display or projector, flip chart, and basic furnishings). The price does not include concierge services, catering, or additional services, which must be ordered separately.

Hygienepassport.fi:
  • The service includes a hygiene passport test conducted in person at a location designated by the Service Provider. The test is administered and the passport issued by a hygiene passport examiner authorized by the Finnish Food Authority (Ruokavirasto).
  • The price includes one test attempt, a paper certificate, and a plastic hygiene passport card (if the test is passed), as well as one domestic mailing to Finland or Åland. The price does not include study materials, training, or access to the Trainify service. These must be purchased separately if desired.

4. INTELLECTUAL PROPERTY RIGHTS

The service (including updates, modifications, and bug fixes), related content, and training materials are protected under copyright and other intellectual property laws. These remain the exclusive property of the Service Provider or its partners. No intellectual property rights are transferred to the user. The user is granted a limited, non-transferable, non-exclusive right to use the materials for test participation or training, but not for any other purpose. Training materials may not be shared or made publicly available.

5. SCOPE OF APPLICATION AND PLACING AN ORDER

These terms apply when a customer registers and purchases a test or training service from the Service Provider’s website. By placing an order, the customer agrees that these terms exclusively govern the order. In general, the purchaser must be at least 18 years old. Persons aged 15–17 may place an order only with parental permission and must pay online. A parent or guardian may place an order on behalf of someone under 15 years of age.

Services may be ordered with or without account registration. The customer must provide the necessary information for processing the order.

Before making a payment, the customer must accept these terms and conditions. Then, by pressing the "Proceed to Checkout" button on the order form, a binding order is placed and registered and a contract is concluded between the service provider and the customer. An order confirmation will be sent to the customer's e-mail address, where the order details can be checked. As a registered customer, you can track your orders through your own account. The service provider has the right to cancel or not accept the order for a justified reason (e.g. the service ordered is not available or cannot be arranged, incomplete contact details, the service/test cannot be delivered at the indicated time, an obvious pricing error in the pricing of the service). If the customer has paid for the order before the service provider cancels the order, the payment will be refunded to the customer.

6. PRICES, PAYMENT METHODS AND TERMS, AND DELIVERY FEES

All prices indicated on the provider's website include VAT and are total prices unless otherwise stated. As a rule, the service is paid for at the time of placing the order. In addition to the price, the customer may have to pay delivery charges (if any), which will be indicated at the time of placing the order and paid at the time of payment for the service. In special cases, the service provider has the right to correct the price of the service after the order has been placed if there has been a manifest error in the pricing.

The Service Provider's payment service provider is Paytrail Plc. Detailed information on the payment methods available and accepted at any given time is provided when the order is placed. Loyal payment methods may also require acceptance of other contractual terms and conditions and the provision of a personal identification number for credit verification purposes. Supported payment methods are determined by the payment service provider's payment methods available at the time, but generally include at least:

  • Online banking
  • Payment cards (debit/credit)
  • Mobile payments (e.g., MobilePay, Pivo, Siirto)

7. CANCELLATION OR MODIFICATION OF ORDER

Under consumer protection law, a consumer customer always has the right to withdraw from a contract concluded by means of distance communication (such as online shopping) within 14 days of the conclusion of the service contract. The moment of the conclusion of the contract is the moment when the service provider has sent the order confirmation to the customer.

Cancellation policies for services ordered from Hygienepassport.fi


Standard test
  • Cancellation at least 12 hours before the test.
  • Late or missed cancellations are fully charged.

Special arrangement test (e.g., read aloud, dictionary)
  • Cancellation at least 7 days before the test.
  • Late or missed cancellations are fully charged.

Translated test
  • Cancellation at least 12 hours before the test.
  • Late or missed cancellations are fully charged.

Translated private test
  • Participant count must be confirmed 7 days in advance.
  • Written notice of cancellation or rescheduling at least 14 days in advance.
  • Late changes are charged 50%.
  • Billing is based on agreed travel costs and confirmed participants unless otherwise agreed.
  • Invoicing fee: 10 € (incl. VAT)

Private tests (e.g., at workplaces)
  • Participant count must be confirmed 7 days in advance.
  • Written notice of cancellation or rescheduling at least 7 days in advance.
  • Late changes are charged 50%.
  • Billing is based on agreed travel costs and confirmed participants unless otherwise agreed.
  • Invoicing fee: 10 € (incl. VAT)

Book orders from Hygienepassport.fi
  • 14-day return right.
  • Products must be unused and in resale condition.
  • Returns must be arranged via email with customer service.
  • Refunds exclude shipping (5,60 € incl. VAT) and handling fee (2,50 €). Customer pays return shipping.

However, in remote sales, the consumer has no right of withdrawal if the test has already been carried out or the test starts before the 14-day withdrawal period expires and the customer has given explicit consent to the start of the service (e.g. accepted the conditions at the time of payment).

If the test is cancelled in accordance with the cancellation conditions and no new appointment is made, an office and handling fee of 2,50 € (incl. VAT 25,5%) will be deducted from the refund per test.

If you as a customer have the right to cancel a service order and wish to do so, we request that you send a written request for cancellation by sending an email to info@hygienepassport.fi, including (1) your name, (2) your address, (3) your phone number and email address, (4) a copy of your order confirmation or order number, (5) details of the services for which you wish to cancel, and (6) where applicable, details for a refund. We will promptly notify you by email of our receipt of your cancellation notice.

If you had already paid for the cancelled order, payment will be refunded to you within a reasonable time after receipt of the cancellation. In principle, the refund will be made by the same method of payment used to make the payment.

The order (e.g. the date of the test) can be changed in principle under the same conditions as the order can be cancelled.

For services ordered from Osaamistehdas.fi

  • Cancellations can be made free of charge 14 days before the booked time. After this period, 50% of the price of the reservation will be charged for cancelled reservations.
  • Reservations cancelled less than 3 days before the booked time will be charged the full price of the reservation, including the room rent, the cost of the caretaker and the catering.
  • If the reservation is not cancelled, the full price of the reservation, including the room rent, the caretaker's fee and the catering, will be charged.

8. EXCEPTIONS TO THE RIGHT OF CANCELLATION (CONSUMERS)

According to Chapter 6, Section 16 of the Finnish Consumer Protection Act (38/1978), the consumer does not have the right to cancel a purchase of digital content (such as a service) if (1) the consumer has consented to the immediate delivery of the digital content, and (2) the consumer has acknowledged the loss of the right of cancellation.

Based on this provision, the consumer generally does not have a right of withdrawal for services offered by the service provider where access to the content or digital service (such as e-learning materials) is granted immediately after the order is placed. Such services include, for example, the Trainify service.

9. LIABILITY FOR DEFECTS

The Service Provider is liable for defects in accordance with applicable laws.

10. PROCESSING OF PERSONAL DATA

You can read more about the processing of customers' personal data in the provider's privacy policy, which can be found at: https://hygienepassport.fi/privacypolicy. The customer's personal data may also be disclosed to the service provider's partner responsible for the implementation of the test or, if required, to public authorities (e.g. the Finnish Food Authority (Ruokavirasto)), which will process the personal data as data controller for its own purposes related to the implementation of the test.

11. GOVERNING LAW AND DISPUTE RESOLUTION

The contract between the parties is governed by Finnish law. Any disputes that may arise will be settled primarily by amicable means. If a dispute cannot be settled amicably, it may be resolved in the first instance by any competent general court. If the customer is an EU consumer, he cannot be deprived of the rights granted to him by the mandatory consumer legislation of his home country. The consumer can always bring an action in the district court of his/her place of residence. Consumers can also use the ODR platform managed by the European Commission to resolve their disputes. This platform can be found at http://ec.europa.eu/odr. In Finland, consumers also have the right to request a recommendation from a consumer dispute panel. Before taking the matter to the Consumer Disputes Board, it is advisable to contact the Finnish Competition and Consumer Authority (for more information: kuluttajariita.fi and kuluttajaneuvonta.fi).

12. OTHER TERMS

Order and Delivery

Book Orders: Book orders placed through the Hygienepassport.fi online store will be delivered as home delivery via Posti's small parcel service unless the customer specifically notifies that they wish to pick up the order. A tracking code for the shipment can be obtained from customer service upon request. Book orders are generally shipped within 1–2 business days after the order is placed.

Electronic Materials: Orders for electronic material placed through the Hygienepassport.fi online store will be delivered to the email address provided by the customer after payment has been completed.

Hygiene Passport Delivery: Hygiene passports are sent as a regular letter to the address provided by the customer approximately 2–4 weeks after the test date. For private groups (e.g. workplaces, schools), hygiene passports are delivered in one batch to the delivery address specified by the ordering party, unless otherwise agreed.

For deliveries of hygiene passports and orders placed through the online store, the customer is responsible for ensuring that the name and contact details provided are accurate and up to date.

If a delivery is returned to Hygienepassport.fi due to incomplete, outdated and/or incorrect address information, the customer is obliged to provide the correct address details for resending the shipment or to pick up the shipment from the Hygienepassport.fi office.

The test price includes one delivery of the hygiene passport within Finland and Åland.*

*Please note: Although Åland is part of the EU, it is outside the EU VAT area, and shipments containing goods require customs documentation. According to Finnish Customs instructions, documents (such as the hygiene passport) are not subject to customs clearance. However, envelopes sent to Åland must visibly include the text "Asiakirja/dokument" (“Document”) in addition to the address. If a hygiene passport is mailed to Åland, the customer is responsible for ensuring that this text is clearly written on the envelope during the test session.

Shipments agreed to be picked up must be collected without delay. Hygienepassport.fi does not store shipments for longer than one month and is not responsible for the continued storage of uncollected items. Hygienepassport.fi is also not responsible for the storage of shipments for which delivery or handling has not been arranged in advance.

Hygienepassport.fi is not responsible for shipments lost in the mail.

Complaints regarding received deliveries (book orders, electronic material, hygiene passports) must be made immediately, but no later than five (5) days after receiving the order.

If a customer has not received their hygiene passport by mail within four (4) months of the test date, they must notify Hygienepassport.fi in writing (by email). If the customer has not reported the missing hygiene passport within four (4) months, they are responsible for covering the costs of ordering a new hygiene passport.

Hardware and Software Requirements


The use of the service may in some cases require: (1) a data connection to use the service and/or to download the mobile application related to the service onto a terminal device; (2) a terminal device such as a computer, smartphone, or tablet with a web browser and/or the service’s application installed; (3) the creation of a user account and acceptance of applicable terms and conditions (e.g., for the Trainify service); (4) logging into the account in order to use the service; and (5) payment of applicable fees, in cases where the service or any of its features are paid or include additional charges. The user is responsible, at their own expense, for acquiring and configuring the required equipment, data connection, and software, as well as for any necessary updates.

Validity of the Terms


These terms shall remain in force for as long as the user uses the service. The service provider may terminate the agreement for the use of the service with immediate effect if the user fails to pay the service fees, uses the service in violation of these terms or applicable laws, the user’s account remains inactive for a long period of time, or the service provider discontinues the provision of the service.

Force Majeure


The service provider shall not be liable for any breach, delay, or failure caused by circumstances beyond its reasonable control (force majeure events).

Limitation of Liability (applies only to corporate and business customers)


The service provider shall not be liable to the customer for any indirect or other consequential damages, including loss of income or revenue, business losses, harm to goodwill, loss of profits, and claims or damages from third parties. Under no circumstances shall the service provider’s liability to the customer exceed the net (VAT-excluded) value of the order to which the liability or breach of contract is most closely related.
